anDREa Processor or Subprocessor?
anDREa BV has a Data Processing Agreement (DPA) with all its clients. It is the Tenant that has to enter the DPA with anDREa BV and in principle, this means that DPAs can differ between Tenants. anDREa strives to have its version of the DPA applicable for collaboration is much easier when the same rules and policies apply. And why would the same GDPR result in a different DPA for very similar processing?
However, regardless what DPA is entered, anDREa BV will always be a processor and not a subprocessor. If in a grant application or collaboration you want to use myDRE that is completely fine but never add or consider anDREa BV as a subprocessor.
Feel free to use the text below to clarify to other parties why no additional DPA is needed nor it is necessary to consider anDREa BV as a subprocessor; replace 'its Tenants' and 'Tenant' with your organization name.
anDREa BV is a service provider for its Tenants and has agreements in place that allow general use of their services, myDRE in particular, by the Tenant for operating its business, including projects for third parties. anDREa BV will therefore not be subcontracted to specific tasks or collaboration, as the Tenant will not (newly) subcontract part of their task to anDREa BV for it is already part of the business operations.
To know exactly the DPA that applies to a Workspace, contact the Support Team for that Workspace. The name of the Tenant to which the Workspace belongs can be found in two places: Workspace overview and in Info & Contact tab of that specific Workspace (see below)
